Copyright & DMCA Policy

1. Introduction

CinemaFreak.net (“we,” “us,” “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the CinemaFreak.net service that are reported to our Designated Copyright Agent, identified in the sample notice below.

2. Procedure for Reporting Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a written notification of claimed infringement (a “DMCA Notice”) to our Copyright Agent via email.

To be effective, your DMCA Notice must include the following information:

a. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

b. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.

c. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. This must include information reasonably sufficient to permit us to locate the material. Providing specific URLs in the body of your email is the most effective way to help us locate content quickly.

d. Information reasonably sufficient to permit us to contact you, such as a name, address, telephone number, and, if available, an email address.

e. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

f. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Delivery of the DMCA Notice

Please deliver this notice, with all items completed, to our Designated Copyright Agent:

Upon receipt of a valid DMCA Notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from our website. We will also notify the user who posted the material, if applicable.

4. Counter-Notification Procedure

If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, a counter-notification must be a written communication sent to our Copyright Agent that includes substantially the following:

a. Your physical or electronic signature.

b. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (the original URL).

c. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.

d. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which CinemaFreak.net may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, CinemaFreak.net has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

6. Disclaimer

Please be advised that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees. We reserve the right to seek damages from any party that submits a DMCA notification in violation of the law.
